As the creation of intellectual property is considered to be the life-blood of any technology company, large companies employ teams of attorneys to manage IP, and small companies consider themselves lucky if they can afford to have one or two people devoted to the process. A difficult obstacle faced by the intellectual property manager is the ability to obtain timely information related to the emergence of IP within the company. Another hurdle to appropriate protection of IP is the constant struggle to maintain adequate documentation of the inventive process. The area of trade secrets can also be problematic, since these are poorly defined. The timely identification and labeling of information as confidential is essential to the protection of trade secrets. Providing internal guidance as to what particular pieces of information warrant trade secret status is another difficult area.
